Terms and Conditions – Homebody Studios Newport

I. Application of These Terms and Conditions (the “Homebody Agreement”)

These Terms and Conditions (“Terms”) govern your relationship with Homebody Studios Newport LLC (“Homebody,” “we,” “us,” or “our”), including your use of our studio, services, memberships, classes, website, and products.

By booking a class, purchasing a membership or package, attending the studio, or otherwise using our services, you agree to be bound by these Terms.

These Terms apply exclusively to the following location:

II. Nature of the Studio & Right to Refuse Service

Homebody Studios Newport is a semi-private, referral-based Pilates studio operating in a residentially zoned area. Access to the studio is intentionally limited to preserve the safety, privacy, and experience of our clients, instructors, and surrounding community.

To the fullest extent permitted by law, Homebody reserves the right to:

  • Limit access to the studio

  • Require referrals, invitations, or pre-approval for participation

  • Decline or terminate memberships, class access, or services

  • Refuse entry or service to any individual whose presence or conduct is disruptive, unsafe, inconsistent with studio policies, or incompatible with residential zoning requirements

This right will never be exercised in a discriminatory manner prohibited by California or federal law. Homebody does not discriminate based on race, color, religion, sex, gender identity, sexual orientation, national origin, disability, medical condition, marital status, age (where legally protected), or any other protected characteristic.

III. Arbitration Agreement and Class Action Waiver

A. Informal Dispute Resolution

Homebody aims to resolve concerns promptly and respectfully. Before initiating formal action, you agree to contact us by email with your name, a description of the issue, and your desired resolution:

B. Binding Arbitration

Except where prohibited by law, any dispute arising out of or relating to your relationship with Homebody shall be resolved through binding arbitration, governed by the Federal Arbitration Act, and administered by JAMS or the American Arbitration Association (AAA).

C. Class Action Waiver

All disputes must be brought on an individual basis. You waive the right to participate in any class, collective, or representative action. If this waiver is found unenforceable, the arbitration provision shall be null and void.

D. Definition of “Dispute”

“Dispute” includes any claim relating to services, memberships, payments, policies, or your relationship with Homebody, excluding personal injury claims and claims related to lost, stolen, or damaged personal property.

IV. Studio Usage Policies

A. Minors

Clients must be 16 years or older to participate. Clients under 18 require written parental or legal guardian consent and must be accompanied by a parent or guardian unless otherwise approved in writing by Homebody.

B. Reservations, Classes, and Gift Cards

  • All classes require advance booking using valid credits or an active membership

  • Gift cards do not expire but are non-refundable once redeemed

  • Pricing is subject to change at any time; existing credits retain their value until expiration

  • Outstanding balances may result in suspension of services and collection efforts where permitted by law

C. Refunds, Cancellations, and Memberships

Class Packages
Refunds are available only if:

  • No classes (including waitlists) have been booked, and

  • The request is submitted within 5 days of purchase

Memberships

  • Membership fees are non-refundable

  • Memberships may be canceled at any time

  • Cancellation requests must be submitted via email

Membership Pauses

  • Two pauses permitted per year, for a minimum of one month

  • Approved for medical or travel reasons

  • Requests must be submitted in writing

D. Class Attendance & Waitlists

  • Late arrival may result in forfeiture of your spot

  • Waitlists should be treated as confirmed reservations

  • Failure to remove yourself from a waitlist may result in a fee

E. Class Cancellation Policy

  • Cancellations must be made at least 12 hours prior to class

  • Late Cancellation Fee: $20

  • No-Show Fee: $25

Fees may be waived at Homebody’s discretion in cases of illness or emergencies if timely notice is provided.

F. Instructor & Schedule Changes

Classes, instructors, and schedules are subject to change without notice.

V. Payments and Billing

  • Accepted payment methods: Visa, MasterCard, Discover, American Express

  • Cash is not accepted

  • Memberships auto-renew unless canceled

  • Class packages expire as stated at purchase

  • Extensions may be granted for extenuating circumstances at Homebody’s discretion

VI. Intellectual Property

All trademarks, branding, content, and materials are the exclusive property of Homebody Studios Newport LLC. Unauthorized use is strictly prohibited.

VII. Privacy & California Consumer Rights

Homebody complies with all applicable California privacy laws, including the California Consumer Privacy Act (CCPA) and CPRA.

California residents have the right to:

  • Access, correct, or delete personal information

  • Request disclosure of collected personal data

  • Opt out of the sale of personal information (Homebody does not sell personal data)

VIII. Assumption of Risk & Release (Recommended Add-On)

Participation in Pilates and fitness activities involves inherent risks. By attending classes, you voluntarily assume all risks associated with physical activity and release Homebody Studios Newport LLC from liability to the fullest extent permitted by law.

(I strongly recommend keeping this section or pairing these Terms with a standalone liability waiver.)
